  1. OUR STATUS

We do not promote a lottery, and we are not lottery promoters.

We are not a gambling or gaming company requiring a licence from the UK Gambling Commission.

Possible Wins operates and makes entry available into Prize Draws. The way in which Possible Wins operates these Prize Draws is designed so that they fall outside the definition of “gambling” in section 3 of the Gambling Act 2005. In particular:

  • every Prize Draw has at least one Free Alternative Method of Entry, including a free postal entry route; and
  • all Free Alternative Entries are treated the same as paid Entries and have an equal chance of winning any Prizes in the Prize Draw to which they relate.

Because no purchase is necessary to enter or win any Prize Draw and because free entries have an equal chance of winning, Possible Wins does not require a gambling licence for the Prize Draws it operates. However, we reserve the right to amend our model if the law changes or if it is otherwise necessary to remain compliant with applicable law and regulatory guidance.

Nothing in these Terms restricts or excludes any rights you may have under the Gambling Act 2005 or other applicable laws which cannot be excluded by contract.

  1. PRIVACY AND DATA PROTECTION

By clicking “I accept” or using the Site or Services, you confirm that you have read and understood our Privacy Policy, which is available on https://possiblewins.co.uk, and that you consent to the collection and use of your personal data as set out in that policy and these Terms.

We will process personal data about you in accordance with:

  • the UK General Data Protection Regulation (UK GDPR);
  • the Data Protection Act 2018; and
  • any other applicable data protection and privacy laws in the UK,

in each case as amended or replaced from time to time.

We may revise the Privacy Policy at any time. Updated versions will be posted on the Site and will apply to your use of the Site and Services from the date of publication. If you do not agree to any updates to the Privacy Policy, you must stop using the Site and Services and close your Account.

  1. THE SITE AND SERVICES

The Site provides access to Prize Draws offering the chance to win a variety of Prizes. The types of Prizes and the nature of the Prize Draws may change from time to time.

You may enter Prize Draws:

  • by creating an Account and purchasing Entries (where permitted); and/or
  • by using the Free Alternative Method of Entry, which includes a free postal entry route (see section 6 and section 27).

No purchase, payment or other financial contribution is necessary to enter or win a Prize Draw. All Prize Draws are void where prohibited by law.

We may add, change, modify, suspend or discontinue any part of the Site or Services at any time in our sole discretion. Your use of the Site, including access to any new features, will always be subject to these Terms.

We may impose limits on certain features or restrict your access to parts or all of the Site or Services without liability or prior notice.

  1. PURCHASING ENTRIES

Where permitted for a Prize Draw, you may purchase Entries for chances to win the Prizes on offer for that Prize Draw.

The pricing and availability of paid Entries are subject to change and may vary from one Prize Draw to another. All prices will be clearly stated on the relevant Prize Draw page before you commit to purchase.

From time to time, we may offer promotions for new or existing paying Users (for example introductory discounts or bonus Entries). Unless expressly stated otherwise:

  • promotions are available only once per person;
  • promotional benefits have no cash value and are not redeemable for cash; and
  • promotions are subject to any additional terms stated when they are offered.

We may impose a monthly or per-Prize Draw spending cap on paid Entries. Any such cap will be clearly communicated on the Site.

  1. FREE ALTERNATIVE METHOD OF ENTRY (INCLUDING POSTAL ENTRY)

Every Prize Draw we operate has at least one Free Alternative Method of Entry. This includes a free postal entry route designed to ensure that no purchase is necessary to enter or win.

6.1 General principles

  • Free Alternative Entries are treated exactly the same as paid Entries.
  • They have the same chance of winning any Prize.
  • They are entered into the same draws at the same time as paid Entries.
  • The selection of winners is always made without distinguishing between paid and free Entries.

6.2 How to enter for free by post

Unless otherwise stated in the description of a particular Prize Draw, you may submit a free postal entry as follows:

  1. Write your details clearly in block capitals on a plain postcard or letter no smaller than A6 and no larger than A4. You must include:
    • your full name;
    • your full postal address (including postcode);
    • your email address registered to (or to be registered to) your Possible Wins Account;
    • your date of birth (you must be at least 18 years old);
    • the name of the specific Prize Draw you wish to enter; and
    • a clear statement that you wish to enter that Prize Draw via the Free Alternative Method of Entry.
  2. Send your entry by first or second class post to:

Free Entry – [insert Prize Draw name]
Possible Wins
ART OF THE POSSIBLE INFLUENCE LTD
Building 7, Floor 5
566 Chiswick High Rd.
Chiswick
London
W4 5YG

  1. Only one free postal entry is permitted per stamped envelope or postcard, unless otherwise specified in the Prize Draw description.
  2. Free postal entries must be received by us before the Closing Date for the relevant Prize Draw. We will not be responsible for entries that are late, lost, delayed, illegible, incomplete, misdirected or damaged.
  3. Any free postal entry that does not comply with these requirements (including unreadable or incomplete entries) may be rejected and will not be entered into the Prize Draw.

We reserve the right to impose reasonable limits on the number of free Entries per person and/or per Prize Draw, provided that such limits are clearly stated in the Prize Draw description and apply equally to paid and free Entries.

  1. REFERRAL ENTRIES

From time to time, Possible Wins may offer referral schemes enabling Customers to receive benefits for successfully inviting others to use the Services.

Where such schemes involve awarding Entries, discounts or other benefits to an inviter, invitee, or both, the award will be subject to the following conditions unless otherwise specified:

  • the inviter must be an active Customer (and, where stated, an active paying Subscriber);
  • the invitee must access the Site using the inviter’s referral link before registering an Account;
  • the invitee must not have previously created an Account or visited the Site using another Customer’s referral link.

If these conditions are met, any referral reward will be credited to the relevant Account(s) within a reasonable period.

Referral rewards:

  • have no cash value;
  • are not redeemable for cash under any circumstances; and
  • may be subject to additional terms published on the Site.

We may remove, amend or otherwise alter any referral scheme (including its availability, value or conditions) at any time without notice.

Where we reasonably suspect a referral scheme is being abused (for example by using multiple Accounts for the same individual or any other fraudulent or manipulative behaviour), we may, in our sole discretion:

  • close the relevant Accounts; and/or
  • revoke any Entries or other rewards awarded under the abusive scheme.
  1. ENTRIES AWARDED AS PRIZES

We may award Entries into future Prize Draws as a Prize in existing Prize Draws.

Entries awarded as Prizes:

  • have no cash value and are not redeemable for cash;
  • may be subject to expiry dates or other conditions stated on the Site; and
  • may be automatically applied to specific Prize Draws selected by us (for example the next available draw of a specified type).

Where Entries are awarded as a Prize, the relevant entry details (such as numbers or identifiers) may be generated randomly and may not be selectable by the Customer.

  1. SUBSCRIPTION ENTRIES

We may offer the option to purchase Entries on a subscription basis for certain Prize Draws.

Where this option is available:

  • you must actively opt in to subscription payments;
  • the price, billing frequency and nature of the subscription Entries will be clearly specified before you confirm; and
  • by subscribing, you authorise us to take recurring payments from your chosen payment method for the relevant subscription.

We will use a secure third-party payment provider to process subscription payments. We may store a unique token representing your payment details (held securely by the payment provider) in order to process “cardholder not present” transactions when subscription payments fall due.

We may from time to time offer free subscription Entries. Any such free subscription may differ in benefits and Prizes from paid subscriptions, as clearly communicated on the Site.

Users who send qualifying postal entries on a regular, recurring basis may, at our discretion, be treated as Subscribers for the purposes of certain perks, provided that this does not affect the equal chance of winning for paid and free Entries.

  1. SUBSCRIPTION CANCELLATIONS

You may cancel a subscription at any time by following the cancellation process in your Account settings or by contacting us at hello@aotp.london.

  • Cancellation takes effect immediately or from the next billing cycle, as stated at the point of cancellation.
  • You will not be charged for any subscription period after cancellation takes effect.
  • Entries already purchased or allocated prior to cancellation will remain valid for the Prize Draw(s) to which they relate.

If you receive a free entry as part of a “subscribe & get your 1st entry free” promotion and you cancel your subscription before the relevant draw takes place, we may invalidate that free entry and it will not participate in the Prize Draw.

  1. REFUNDS

Under normal circumstances, Entries purchased via the Site or via subscription are non-refundable.

If we cancel a Prize Draw after Entries have been purchased and do not reschedule or transfer those Entries to another Prize Draw, we will refund amounts paid in respect of that Prize Draw to the payment method used.

This does not affect any statutory rights you may have as a consumer that cannot be excluded by law.

  1. INTERNET ACCESS

You are responsible for any internet connection, data usage and telecommunication charges you incur when accessing the Site or using the Services.

  1. ACCOUNTS

To use certain parts of the Site or Services (including entering Prize Draws), you may be required to register on the Site and create an Account.

Eligibility is limited to individuals who are:

  • at least 18 years old; and
  • resident in the United Kingdom.

As part of the registration process, you must provide certain personal information, including contact details. You agree that:

  • all information you provide is true, accurate, current and complete; and
  • you will promptly update your details to keep them true, accurate, current and complete.

You must keep your password and login details confidential and secure. You must not:

  • allow any other person to use your Account;
  • share your password;
  • create or use an Account in the name of another person; or
  • use an email address or username that is offensive, misleading or infringes the rights of any third party.

You agree to notify us immediately at hello@aotp.london if you become aware of or suspect any unauthorised use of your Account or any other breach of security.

You are responsible for all activities that occur under your Account, whether or not authorised by you. We are not liable for any loss or damage arising from your failure to safeguard your Account credentials.

Employees, directors and officers of ART OF THE POSSIBLE INFLUENCE LTD (and any group companies) may be restricted or prohibited from entering Prize Draws in order to ensure fairness and transparency. Any such restrictions will be detailed in our internal policies and/or specific Prize Draw rules where applicable.

  1. TERMINATION OF ACCOUNT

You acknowledge and agree that:

  • you have no ownership rights in your Account; and
  • we may access, suspend or terminate your Account at any time and for any reason, including for breach of these Terms or for misuse of the Site or Services.

If we terminate or suspend your Account, we may (but are not obliged to):

  • cancel, delete or anonymise your Registration Information and User Content; and/or
  • restrict or block your future access to the Site and Services.

We are not liable for any loss of User Content arising from termination or suspension of your Account.

You may close your Account at any time by contacting us or via your Account settings, where available.

  1. POLICY FOR VULNERABLE PLAYERS

We are committed to ensuring that Prize Draw Entries are not knowingly sold to or encouraged from vulnerable persons, including (without limitation) people:

  • under the influence of alcohol or drugs;
  • who are incoherent; or
  • who are suffering from certain conditions that may impair decision-making (such as dementia or similar serious cognitive impairments).

We reserve the right to politely refuse to assist any person in purchasing Entries where we reasonably believe that they may be vulnerable and incapable of making an informed decision. Where appropriate, we may suggest that the person obtains assistance from a carer or family member before proceeding.

We may monitor our communications with Customers and, where vulnerability becomes apparent, we may:

  • cancel any subscription or recurring Entries; and/or
  • cease game-related communications with that Customer.

We may also provide signposting to relevant support organisations where appropriate.

  1. LIMITED LICENCE TO USE SITE AND SERVICES

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and Services for your personal, non-commercial use only.

You must not:

  • modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, software, products or services obtained from the Site, except as expressly permitted by us;
  • reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of any software underlying the Site;
  • sublicense or assign your rights under these Terms without our prior written consent; or
  • make any false, misleading or deceptive statement about Possible Wins or the Site.

We may suspend, terminate or withdraw this licence at any time without notice.

  1. USE OF SITE AND SERVICES

You must use the Site and Services in compliance with all applicable laws and regulations.

You must not, in connection with your use of the Site:

  • infringe any intellectual property rights or other rights of any person;
  • transmit any material that is defamatory, obscene, hateful, discriminatory, harassing or otherwise objectionable;
  • engage in any fraudulent, abusive or illegal activity (including, without limitation, any attempt to manipulate the outcome of a Prize Draw);
  • attempt to gain unauthorised access to the Site, any Accounts other than your own, or our systems or networks;
  • introduce any viruses, trojans, worms, logic bombs or other malicious code;
  • conduct denial-of-service attacks or similar activities; or
  • use automated scripts, bots or scraping tools without our prior written consent.

You are solely responsible for your User Content and for any consequences of posting or transmitting it. We do not endorse, support or guarantee the completeness, truthfulness or reliability of any User Content.

We may remove, block or edit any User Content that we consider to be in breach of these Terms or otherwise inappropriate, without liability and without notice.

  1. THIRD PARTY PRODUCTS

Third party services, content, information and products may be made available through the Site (Third Party Products). We:

  • do not endorse or make any warranties or representations about Third Party Products; and
  • are not responsible or liable for Third Party Products or any dealings you may have with third parties.

Third Party Products are subject to the terms and policies of the relevant third party providers.

  1. HYPERLINKS

The Site may contain links to third party websites. These links are provided for your convenience only. We do not control and are not responsible for the content or availability of those websites.

The inclusion of any link does not imply endorsement by Possible Wins of the linked site or any products or services referenced there.

You may link to the Site only if:

  • the link is fair and legal and does not damage our reputation or take advantage of it;
  • you do not suggest any form of association, approval or endorsement on our part where none exists; and
  • the Site is displayed in full screen and not framed within another site.

We may revoke linking permission at any time.

  1. INTELLECTUAL PROPERTY

All intellectual property rights in and to the Site and Services (including, without limitation, all content, design, text, graphics, software, logos and trademarks) are owned by us or our licensors.

You do not acquire any rights in or to such intellectual property except as expressly provided in these Terms.

You may not use our name, logo or other trade marks without our prior written consent.

If you believe that any content on the Site infringes your intellectual property rights, please contact us at hello@aotp.london with full details.

  1. DISCLAIMER OF WARRANTIES

The Site and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all warranties, representations and guarantees (whether express or implied) in relation to the Site and Services, including any implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement.

We do not warrant that:

  • the Site will be available at any particular time or location;
  • the Site or Services will be uninterrupted or error-free;
  • any defects will be corrected; or
  • the Site is free from viruses or other harmful components.

You use the Site and Services at your own risk.

Nothing in these Terms affects any rights you may have under law which cannot be excluded.

  1. LIMITATION OF LIABILITY

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot be limited or excluded by law.

Subject to the above, and to the fullest extent permitted by law:

  • we will not be liable for any indirect, incidental, consequential, special or punitive losses or damages, or for any loss of profits, revenue, data, business or goodwill arising out of or in connection with your use of (or inability to use) the Site or Services; and
  • our total aggregate liability to you in connection with the Site and Services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed £120.

Your sole remedy for dissatisfaction with the Site or Services is to stop using them and, where applicable, close your Account.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless Possible Wins, ART OF THE POSSIBLE INFLUENCE LTD, and our respective officers, directors, employees, agents and affiliates from and against any and all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with:

  • your use or misuse of the Site or Services;
  • your breach of these Terms; or
  • your infringement of any rights of a third party.
  1. ANTI-MONEY LAUNDERING POLICY

We are committed to preventing our systems from being used for money laundering, terrorist financing or other criminal activity.

To that end, we may (amongst other things):

  • appoint a designated Money Laundering Reporting Officer (MLRO);
  • take reasonable steps to verify the identity of Customers;
  • keep appropriate records of Customers and transactions;
  • provide training to relevant staff regarding anti-money laundering obligations;
  • refuse to open anonymous or fictitious Accounts;
  • require that withdrawals are paid back to the same payment method where possible;
  • decline cash payments;
  • terminate Accounts where false information has been provided; and
  • report any suspicions of money laundering or terrorist financing to the relevant authorities.
  1. GOVERNING LAW AND JURISDICTION

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to resolve any disputes arising out of or in connection with these Terms or your use of the Site or Services.

  1. GENERAL
  • Nothing in these Terms creates any joint venture, partnership or agency relationship between you and us.
  • We may assign or transfer our rights and obligations under these Terms to another organisation at any time. You may not assign or transfer your rights or obligations without our prior written consent.
  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Our failure to enforce any right or provision in these Terms shall not constitute a waiver of that right or provision.
  • All notices to us under these Terms must be in writing and sent to hello@aotp.london.
  • These Terms, together with any documents expressly referred to in them (including the Privacy Policy and Prize Draw Rules), constitute the entire agreement between you and us in relation to the Site and Services and supersede any prior agreements or understandings.
  1. PRIZE DRAW RULES

This section sets out the general rules that apply to all Prize Draws. Additional rules may apply to specific Prize Draws and will be stated in the relevant description on the Site. If there is any conflict between these general rules and any specific rules, the specific rules take precedence.

27.1 Eligibility

Unless otherwise specified in the Prize Draw description, Prize Draws are open only to individuals who:

  • are at least 18 years old;
  • are resident in the United Kingdom; and
  • have created and verified an Account on the Site (or provide sufficient details via the Free Alternative Method of Entry to allow us to create an Account on their behalf if necessary).

We may require proof of age and identity. Entries from ineligible persons may be disqualified and, where applicable, Prizes may be withheld or re-awarded.

27.2 How to enter

Details of how to enter each Prize Draw (including any entry limits or spend caps) will be set out on the Prize Draw page. This will include:

  • how to purchase Entries (if available); and
  • how to use the Free Alternative Method of Entry (including the free postal route in section 6).

Where a monthly or per-draw spending cap applies, we reserve the right to reject or refund any payment which would cause the cap to be exceeded and/or to disregard Entries in excess of that cap.

27.3 Closing Date and Draw Date

Each Prize Draw will state a Closing Date and a Draw Date (or window).

  • Entries (paid and free) received after the Closing Date will not be entered.
  • We will not draw any winner(s) until after the Prize Draw has closed and all valid Entries have been recorded.

We will not extend the Closing Date for any Prize Draw unless clearly stated on the Prize Draw page or required by circumstances beyond our reasonable control.

27.4 Selection of winners

Once the Prize Draw is closed, winner(s) will be selected at random from all valid Entries using either:

  • a random number generator;
  • an independent third-party random selection system; or
  • another method that ensures a fair and random outcome.

We may appoint an independent person to supervise or verify the draw process where required by law or regulation or where we consider it appropriate.

Our decision regarding any aspect of a Prize Draw (including the selection of winners and the interpretation of these rules) is final and no correspondence will be entered into.

27.5 Invalid or disqualified Entries

We may disqualify any Entry that:

  • is incomplete, illegible or fails to comply with these Terms or any specific rules;
  • is submitted by or on behalf of an ineligible person;
  • is made using multiple, false or fraudulent identities or Accounts;
  • is suspected of being part of any attempt to interfere with or manipulate the outcome of a Prize Draw; or
  • is received after the Closing Date.

If a winning Entry is disqualified, we may, at our discretion, select an alternative winner in accordance with these rules.

27.6 Publicity and winner information

Subject always to our Privacy Policy and applicable data protection law:

  • we may publish the first name, initial of surname and county of residence of winners; and
  • winners may be asked, but are not obliged, to participate in reasonable publicity (such as interviews, photos or social content) to promote Possible Wins and future Prize Draws.

We will not share more information about winners than is lawful and reasonable, and only with consent where required.

  1. PAYMENT OF PRIZES

The method of awarding and fulfilling each Prize will depend on the nature of the Prize and will be stated on the Prize Draw page where possible.

By entering a Prize Draw, you acknowledge that:

  • Prizes are non-transferable and (unless expressly stated) there is no cash alternative;
  • we may substitute a Prize (or a component of a Prize) with an alternative of equal or greater value where circumstances require (for example, where a specific product, service or experience becomes unavailable); and
  • where a Prize involves travel, accommodation or experiences, additional terms and conditions may apply (for example from airlines, hotels, tour operators or insurers).

Winners may be required to:

  • provide proof of identity and eligibility; and
  • complete any verification or consent forms reasonably required before a Prize is confirmed or fulfilled.

If a winner:

  • cannot be contacted within a reasonable period after we first attempt to notify them;
  • does not respond to our communications within the deadline we specify; or
  • is disqualified or found ineligible,

we may withdraw the Prize and select an alternative winner or otherwise dispose of the Prize at our discretion.

  1. TAXATION OF PRIZES

To the best of our knowledge, Prizes won from entries sold and Prize Draws operated in the UK are currently not subject to UK income tax.

However, we do not provide tax advice and do not accept responsibility for any tax liability incurred by winners. You are responsible for your own tax and financial affairs and should seek independent advice if in doubt.

  1. DISPUTES

If you have any complaint or dispute regarding the Site, Services or any Prize Draw, please contact us in the first instance at hello@aotp.london so we can try to resolve it informally.

If a dispute cannot be resolved informally, you agree that:

  • any legal proceedings shall be brought only in the courts of England and Wales; and
  • (where permitted by law) you will bring any claim in your individual capacity and not as part of any collective or class action.
  1. GIFT CARDS

If we offer gift cards or vouchers for Possible Wins:

  • they will represent pre-payment for specified Entries or subscription periods as described at the point of purchase;
  • they will not be refundable or exchangeable for cash (except where required by law);
  • they will be valid only for the period stated at purchase or on the card; and
  • they may be subject to additional terms stated on the Site.

Gift card recipients will usually be treated as Subscribers (where the gift relates to subscription Entries) and will have the same odds and rights in Prize Draws as other Users with equivalent Entries.

  1. TOKENS

If Tokens are made available:

  • Tokens are not money and have no cash value;
  • Tokens can only be used in the manner specified on the Site (for example, to obtain Entries or in-platform rewards);
  • Tokens may be awarded as part of promotions, Prize Draws or other activities;
  • Tokens may be subject to expiry dates or other conditions; and
  • any unredeemed Tokens at the time of expiry may be forfeited or converted into an alternative non-cash benefit (for example, a charitable donation) as described on the Site.

We may amend, suspend or withdraw any Token scheme at any time, provided that such changes will not adversely affect Tokens already redeemed.

  1. CHARITY

From time to time, we may associate certain Prize Draws or sales with charitable contributions. Where we do this, we will:

  • clearly state which charity or cause is being supported;
  • specify how the contribution is calculated (for example “X% of net proceeds” or “£X per purchase”); and
  • ensure that any claims made about charitable donations are accurate and not misleading.

Unless expressly stated otherwise, free postal entries will not contribute to any charitable donation (because we receive no revenue from them).

  1. PROMOTIONAL REWARDS

We may from time to time make available optional promotional rewards (the Promotional Rewards) in connection with Prize Draws (for example, bonus Tokens, free Entries, discounts or gifts).

Promotional Rewards:

  • are free benefits offered at our discretion;
  • are not part of the Prize Draw itself and do not affect the odds, conduct or outcome of any Prize Draw;
  • have no cash alternative and are non-transferable unless we expressly state otherwise; and
